"A Sharp Pencil In Firm Hands Could Eliminate The K.P.B. Budget Crisis Without New Taxes!"

 

 

Initiatives may be used at any time by the public to write new or modify existing law whenever the governing body is not receptive or responsive to an issue.  There are some limits to this power such as not appropriating public money by initiative.  The Alaska State Constitution and State Statutes are very clear as to what these limits are.  Anything NOT listed in this prohibition are subject to initiative action by citizens.

March 2009 - A.C.T. prepares to introduce the latest version of the revenue cap.  If the borough rejects the petition again A.C.T. has two options.  If the money is available to fund a legal challenge it will be done with expedited hearings in an attempt to get this placed on the 2009 ballot.  If the money is not available then the petition will be delayed for another year during which time the public is not protected by provisions of the proposed cap.  Donations can be made to support this effort without limit.  Donation details can be found at this link.

 

October 2007 - A.C.T. introduced the total revenue cap called ACT-CAP which was denied by the KPB even though it is substantially the same as revenue caps in Anchorage, Fairbanks, and MatSu Boroughs.  The Kenai Borough decided to withhold approval until a legal challenge  forces them to allow a public vote on this issue.

 

October 2007 - The question of term limits for borough assembly and school board members was put on the municipal ballot by initiative ordinance and passed by a majority of voters.  The borough chose to over turn the election results and A.C.T. fought hard in court to have the public finally be heard.  On August 14, 2008 the court ruled in favor of A.C.T. on term limits for assembly members that would take effect with the 2008 election.

June 22, 2007 - The borough assembly has a long history of ignoring voters on term limits.  A.C.T. took notice and did something about it by filing initiative petitions for term limits on the Kenai Borough Assembly and School Board Members.

April 19, 2006 - The Alliance of Concerned Taxpayers (A.C.T.) files ACT XXIV, an initiative called “ACT-CAP” that limits KPB tax revenue without voter approval.

 

Sets Sales Tax Cap at 2% and Requires Public Vote to Increase - ACT XIX - Filed June 8, 2005 and certified as ballot proposition #5 on August 5, 2005.  APPROVED BY VOTERS October 2005.

 

May 11, 2005 - Sets Property Tax Cap at 6.5 mills and Requires Public Vote to Increase - ACT XIV - Filed May 11, 2005 and rejected by borough for legal reasons on May 25, 2005.  Multiple attorneys contacted by ACT are of the opinion that the borough has cited a weak reason for denying this initiative.  The only course of action available at this time is to raise about $30,000 and mount a legal challenge to let this issue be put to voters.  Fund raising for this action has begun, see the Donations Page for more information.

 

Lowers Assembly Spending Limit for Capital Projects from $1.5 to $1 million and Requires Public Vote for Any Project Costing More Than $1 million - ACT X - Filed April 21, 2005 and certified as ballot proposition #4 on August 5, 2005.  APPROVED BY VOTERS October 2005.
